SAN MARCOS, Texas (Reuters) - A Texas woman who was videotaped taking off her top at a spring break party won a $5 million judgement from the producers of "Wild Party Girls" videos after she spotted herself in a TV ad for the tapes.

Amber Kulhanek, a 22-year-old senior at Southwest Texas State University, sued Arco Media, the Florida-based producers of the risque videos made famous in late night TV ads.

Kulhanek took action after her picture appeared in a TV advertisement for the videos broadcast on cable networks.

"She never signed a consent to have anybody film it," said attorney David Sergi. "Quite frankly, she was too drunk to legally give a valid consent."

The state district court in Hays County, Texas, entered the judgement this week after Arco failed to respond to Kulhanek's suit. Kulhanek must now try to collect the cash.

In previous cases, courts have ruled that there is no expectation of privacy in a public place, and has upheld the right of companies to videotape the actions of women who bare their breasts, and more, at events like Mardi Gras.

Kulhanek, an art student, was filmed in a bar in Matamoras, Mexico, in 2000. She was goaded, Sergi said, into taking part in a wet T-shirt contest that ended up with her shirt coming off completely.

It occurred in 2000 while she was on spring break, the annual collegiate bacchanal, in nearby South Padre Island, Texas.

Kulhanek saw herself in the advertisement, and developed insomnia that led to her dropping out of school.

"The next thing she knew, all of her friends were giving her grief about it. Strangers were coming up to her and making rude and sexually graphic remarks, asking her to take off her clothes," Sergi said.

yeah, it is an odd law. a good friend of mine that works over at the korean branch of my company told me about this - i was really shocked and thought maybe it was an asian business practice.

in a way, i think that its cool b/c sometimes when i'm on the rag i would love to stay home in bed. however, on the other hand i think its a bit condescending towards women and would give someone a better excuse to hire or promote a man over a woman, which sucks.

BERLIN (Reuters) - A German town has found that sleeping on the job, albeit in limited doses, can boost workers' efficiency.


For two years, civil servants in the small town of Vechta southwest of Hamburg, have been allowed 20 minutes after lunch to go home and take a nap, doze in their office chairs or otherwise relax, town spokesman Frank Kaethler said.

"In the beginning employees were skeptical about the project," he said on Monday. "But then they were happier and they started working better."

Kaethler said Vechta started the project because it had too much work for too few employees and no budget to hire new civil servants. A local health insurance company gave them courses on napping.

Research by the Institute for Sleep Research and Medicine in Regensburg found that 22 percent of the overall German population naps. But institute head Juergen Zulley said only Vechta appeared to have implemented a sleeping-on-the-job project.

"Work and sleep are normally seen as opposites and many firms don't want it to be said that their employees sleep in their company," Zulley said.

High school students face criminal charges for prank

NORTH RICHLAND HILLS, Feb. 26 - Seven Richland High School students are in trouble for a childish prank. Not only are they in trouble at school - they face criminal charges.

North Richland Hills Police Sgt. Andy Kancel said, “It happened last Wednesday night in the parking lot of this North Richland Hills discount store.”

An off-duty officer noticed seven teenagers acting strange. Police said they were placing a dollar bill on the sidewalk, and then returning to their car to videotape people picking up the bill.

Turns out, police said, the teens had put human feces on it.

Sgt. Kancel said, "I haven't actually seen all the tape. I saw a small portion of it. But basically they are filming the reactions that they get from these subjects that are out on the street or on the sidewalk when they pick up the dollar bill with the feces on it."

Police said the same teens also pulled another prank, putting an outhouse in somebody's front yard.

Officers said what the teens did was a lot more than just a teenage prank.

"Well, I think when you look at the big picture, you have the totality of the circumstances warranted the issuance of the tickets... the misdemeanor criminal mischief citations," Sgt. Kancel said.

All seven teens played on Richland High School's baseball team. They were suspended Friday night.

In a twist to all this, the police department has launched an internal investigation into complaints by two parents that officers may have violated procedures. But it's unclear exactly what the parents claim the officers did.

Police said the videotape the teens made is evidence and won't release it. NBC 5 couldn't reach the students' parents for comment because police haven't yet released their names.

A point of clarification: The suspension only affects the boy's extra-curricular activities… they havn't been suspended from school.
